1. Agreement to Terms

These Terms of Service ("Terms") bind you and AllinPets.com LLC ("AllinPets", "we", "us") for use of our website, mobile apps, and services ("Services"). By using the Services, you agree to these Terms and our other posted policies, including the Privacy Policy and the Care Triangle non-profit initiative Terms below. Updates may occur; material changes notified 30 days in advance via website, email, or SMS. Continued use means acceptance of updated Terms.


2. Platform Purpose and Disclaimer

AllinPets.com is a mission-driven platform for users (individuals, breeders, pet stores, providers, shelters) to post ads, info, and entertainment about animals, products, services, and adoptions. It supports the AllinPets Care Triangle non-profit initiative (sponsors, families in need, shelters) — see separate section below.
We are a neutral platform, not mediating transactions, verifying content, or guaranteeing listings/outcomes. Users are solely responsible for compliance with all laws (e.g., animal welfare).
Section 230 Notice: Per 47 U.S.C. § 230, we are not liable for user content. Affiliate links disclosed as required.
Care Triangle non-profit initiative: Participation is governed by special terms below.


3. Eligibility, Verification & Age Restrictions

You must be 18+ (or majority age locally). Ages 13–17 need U.S.-based parental/guardian consent. Under 13 prohibited. Complies with COPPA.
We may require age verification or other checks (including KYC, background, animal abuse registry, etc.) at our discretion, but are not obligated to do so. We may use third-party providers for such checks.


4. Account Registration & Security

Provide accurate data, secure credentials, notify us within 24 hours of unauthorized use. You’re responsible for account activity. We may suspend/terminate accounts at our sole discretion for any or no reason. Two-factor authentication encouraged.


5. User Content (UGC) & Licensing

a) Submitting content grants AllinPets a worldwide, royalty-free, perpetual, sublicensable license for operational/marketing use, including derivative works. You warrant ownership or rights to your content.
b) Public Nature: Content may be public/indexed; copies may persist post-deletion.
c) No Obligation: We may review, edit, refuse, or remove any content at our sole discretion, without notice or explanation.
d) Copyright: Report IP violations to [email protected]. Moral rights waived where permitted.


6. Content Removal, Editing & Moderation

You may edit/delete your content at any time. We may remove violative content, or any content, within 10 days or sooner, at our sole discretion, without notice or explanation. Deletion does not guarantee removal from third-party caches.
We may suspend or terminate any account, for any or no reason, without notice or liability.


7. Prohibited Conduct

No: law violations, false/infringing content, impersonation, harassment, bots/data harvesting, security bypass, unauthorized access, animal cruelty, illegal transactions, or unfair competition.
No manipulation or abuse of the platform, users, or staff.
Violations may result in immediate suspension, termination, or reporting to authorities.


8. Purchases, Subscriptions, Payments & Refunds

Provide valid payment. Prices/taxes may vary. Subscriptions auto-renew (notified 7 days prior); cancel via settings.
We may correct, adjust, delay, or withhold payments, to handle disputes, chargebacks, fraud, or errors at our sole discretion.
Refunds are final unless required by law (e.g., Cal. Civ. Code § 1770); Care Triangle contributions are non-refundable unless required by law.


9. Reviews and Community Standards

Only post genuine, experience-based reviews. False/offensive statements or coordinated campaigns are prohibited. We may remove or edit reviews at our discretion.


10. Mobile Applications

Use the app under a limited license; updates may be required. No reverse engineering/resale. Subject to app store rules and these Terms.


11. Third-Party Content, Ads, and Links

May include third-party content/ads/links. We do not endorse or control them and are not liable for use or damages.


12. Privacy Policy

See Privacy Policy. By using the Services, you consent to U.S. data processing. We comply with VA CDPA, CO Privacy Act, and applicable laws.


13. SMS, Email & Electronic Communications

You consent to receive legal notices and communications (including for transactions, changes, etc.) by email and/or SMS. These notices are legally binding, equivalent to paper notices. Opt out of SMS at any time by replying "STOP".
Electronic records and signatures are valid per 15 U.S.C. §7001 et seq.


14. Professional & Expert Content

Licensed professionals’ content is informational only. Reliance is at your own risk; we do not warrant accuracy.


15. Modification, Service Interruptions & Changes to Terms

We may modify or discontinue Services at any time, with or without notice. Terms updates notified 30 days in advance.


16. Termination

We may suspend or terminate your account for any reason, at our sole discretion, with or without notice. Appeal by contacting [email protected]. Creation of new accounts after termination is prohibited without permission.


17. Intellectual Property, Copyright & DMCA

We retain all rights to platform content (not user content). DMCA complaints to [email protected]. Counterfeit goods prohibited.


18. Buyer/Angel/Family/Shelter Protection Policy

We strive to foster a trustworthy environment but do not guarantee any transactions, listings, or user conduct. At our sole discretion, on a case-by-case basis, we may provide limited support or assistance to users who report issues with a transaction or service.
This may include (but is not limited to) investigating complaints, offering refunds, adjusting or withholding payments, or providing guidance.
We reserve the right to decline any support or assistance and make all decisions at our absolute discretion.
We are not liable for any losses, damages, or unmet expectations between users.


19. Release / Waiver of Claims Between Users

By using the Services, you agree that any disputes, claims, or controversies between users (including, but not limited to, buyers, sellers, breeders, angels, families, or shelters) are solely your responsibility.
AllinPets is not a party to any user-to-user contract, and expressly disclaims all liability for disputes, damages, or losses arising between users.
To the fullest extent permitted by law, you release and waive any claims against AllinPets, its officers, employees, and agents, for any disputes or issues arising out of user-to-user interactions.


20. Dispute Resolution Between Users

You are solely responsible for your interactions with other users.
We may, but are not obligated to, assist in mediating or investigating disputes at our sole discretion, with no liability to resolve any dispute.


21. Indemnification

You agree to indemnify and hold harmless AllinPets, its affiliates, and staff for any claims resulting from your content, use, or violations. Liability is limited to reasonable costs.


22. Limitation of Liability & Disclaimer

Not liable for indirect, incidental, or consequential damages, or data loss, except for gross negligence. Services and content are provided “AS IS” and “AS AVAILABLE,” without warranties. Liability is capped at six months’ payments.


23. Arbitration, Class Action Waiver & Dispute Resolution

All disputes with us are subject to binding individual arbitration (AAA, FAA), with no class actions. Exceptions: small claims, IP disputes (Alexandria, VA), CA public injunctions. Opt out within 30 days to [email protected].


24. California Compliance Disclosures

CA residents may request data info/deletion/opt-out (no sale); non-discrimination. Contact [email protected].

24.2 Shine the Light
No third-party marketing data sharing.

24.5 California Minors

24.6 Additional State Compliance
Complies with VA CDPA, CO Privacy Act, Texas Bus. & Com. Code § 541.


25. General Legal Terms

These Terms, the Privacy Policy, and other posted policies are the binding agreement between you and AllinPets.
Severable. No user assignment; we may assign. No waiver. Notices via email/SMS to your registered contact. English only.


26. Governing Law & Venue

Virginia law (CA law for CA residents, others as required). Venue: Alexandria, VA, unless otherwise required.


 

AllinPets Care Triangle non-profit initiative — Terms & Conditions

1. Introduction

The AllinPets Care Triangle non-profit initiative (“Program”) connects families in need, shelter pets, and sponsors (“Angels”). Participation is subject to these Terms, and Privacy Policy, and all applicable laws.


2. Definitions

  • Family: Low-income U.S. household applying to adopt a shelter pet and meeting Program eligibility.

  • Shelter Pet: Animal listed by a participating, approved shelter.

  • Angel: Individual or entity sponsoring monthly pet expenses.

  • Shelter: Participating animal welfare organization or shelter.

  • Ambassador: Individual/entity spreading awareness about the Program.

  • Match: Approved pairing of a Family and Shelter Pet.


3. Eligibility & Registration

  • Families: U.S. residents; income-verified; minimum age 18 (or as required by law); must comply with all local/state laws.

  • Angels: Age 18+; payment verification; may be subject to KYC or background checks as required by law or AllinPets policy (but not guaranteed).

  • Shelters: Must pass vetting, provide required documentation/licenses.

  • Register via allinpets.com/care-triangle

  • Participants may be asked for ID, proof of income, etc.

  • Data is handled per Privacy Policy and law.


4. Program Participation

  • Apply online, submit required documentation, undergo vetting, await approval.

  • Participation is subject to Program capacity and AllinPets’ sole discretion.

5. Roles and Responsibilities

5.1 Family

  • Provide a safe, loving home and meet all care standards per law.

  • Submit periodic updates as required.

  • Notify AllinPets of major life changes (move, income, etc.).

  • Follow Program rules.

5.2 Angels

  • Commit to a monthly contribution ($25–$100 or as agreed).

  • Payments via secure provider (Stripe or similar).

  • May withdraw with 30 days’ written notice.

  • Angels are not liable for expenses beyond agreed support.

5.3 Shelters

  • List eligible animals, maintain accurate records.

  • Cooperate with AllinPets staff.

  • Maintain all required licenses.

5.4 Ambassadors

  • Promote ethically; do not make unapproved promises.


6. Support & Payments

  • Contributions are pooled and used exclusively for pre-approved expenses (food, vet care, etc.).

  • Payments are made directly to vendors/shelters, never to families.

  • If an Angel withdraws or stops paying, AllinPets will cover the gap until a replacement is found.

  • All extra/one-time support is voluntary.

  • Contributions are non-refundable except as required by law.

  • Angels receive a monthly itemized report.

  • All finances comply with non-profit/charitable law.


7. Reporting & Transparency

  • Angels get monthly reports.

  • All personal/financial data is handled per Privacy Policy and law.


8. Prohibited Conduct

No participant may:

  • Provide false/incomplete/misleading information.

  • Use funds outside allowed purposes.

  • Engage in fraud, abuse, or illegal conduct.

  • Attempt to game the Program.

Violations may result in immediate suspension/removal, with possible reporting to authorities.


9. Privacy & Data Use

  • Data used solely for Program admin/communication, in compliance with law.

  • Participants may request access/correction/deletion by emailing [email protected].

  • Data not sold or shared for marketing without explicit consent.

  • CA residents: right to request data usage info and opt out.


10. Program Changes & Termination

  • AllinPets may modify/discontinue the Program or these Terms at any time, with at least 30 days’ notice (unless urgent).

  • Participants may withdraw at any time by notifying [email protected].

  • Participation may be terminated for rule violations, non-payment, or fraud.


11. Dispute Resolution

  • Most disputes resolved first by good-faith negotiation by email.

  • If not resolved, disputes are subject to binding arbitration (AAA, FAA), except where prohibited by law.

  • No class actions; small claims/IP exceptions as above.

  • Governing law: Virginia (CA/other states as required).
